BASIC BREAKDOWN OF THE TERMS AND CONDITIONS​

The location is Chambers Island, Maroochydore QLD 4558

​

A total of $210.00 AUD (+ GST only if applicable) paid in full is required to secure the booking. There is no per-session payment or booking option.

​

This price includes use of communal tackle supplied by the Coach, not to be taken home by Clients, but used during the sessions. A rod/reel combo can be organised by us for the child at an extra cost of $30.00 (one per child up to 2 children per household), to be included on the one invoice. 

​

There are four (4) client spots available for each program.

​

The program start dates and times are displayed on the main website information page. Each session is one and a half (1.5) hours duration.

​

Sessions are to go ahead on days when low-moderate rain, showers and wind is forecast on the Bureau of Meteorology (BOM), but not when dangerous conditions are experienced and/or forecast. 

​

It is recommended Clients bring a rain jacket/poncho and any other appropriate clothing/accessories in case of wet weather.

The Coach will determine within 24-hours of each session starting, with as much notice as possible via text message, email or phone call, during poor weather periods if the session is to be postponed to another week directly after the original Service end date.

​

ANY sessions missed (all types of cancellations and no-shows) by the Client within the program are forfeited and cannot be made-up at a later date. 

​

The Parent/Guardian needs to contact  the Coach if running late or unable to attend sessions. No-shows and no communication may result in the Client not being invited to return to future programs, attend events etc. Please be respectful of the Coach's time by sending them a text message as early before session start times as possible to advise of running late/not attending.

Refunds are not available after payment has been made.
 

The Client is responsible for bringing, maintaining and managing own line, rod and reel each session. 

This Service includes the use and handling of sharp hooks that can cause harm and injury. 

​

The Client is allowed to take home legal sized fish at the discretion of the Parent/Guardian, and Parents/Guardians are responsible for the transportation, cleaning and consumption of fish after each session has ended. 

​

There is no guarantee the Client will catch fish or make friends during the course of the Service.

FULL TERMS AND CONDITIONS

 

GENERAL

"Client" refers to the child, on behalf of the parent/guardian.

"Parent" refers to the parent, guardian or appointed carer/support worker responsible for the child at any time relating to this Service.

"Coach" refers to the Fishing Coach taking the particular program.
"Service" refers to this program.

"Organisation" refers to Autism & Beyond Australia.

These Terms and Conditions apply to the exclusion of any other conditions proposed by the Client, unless otherwise agreed by Autism & Beyond and the Client in writing.  

ACCIDENT WAIVER AND RELEASE OF LIABILITY

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THIS ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I certify that I am physically fit, have sufficiently prepared or trained for participation in the Service and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this Service.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the Service in which I may participate, and that it will govern my actions and responsibilities at said  Service.

In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Clint Bauer and Aimee Clark and/or their directors, officers, employees, volunteers, representatives, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers;

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise.

I acknowledge that Clint Bauer and Aimee Clark and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of this Service.

I acknowledge that this Service may involve a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the Service, and lack of hydration. These risks are not only inherent to participants, but are also present for volunteers.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this Service.

The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

FIRST AID:
A certified First Aider will be present at the Service in the case of emergencies as well as a First Aid Kit and emergency services will be contacted if necessary.

PAYMENT:
A total of $210.00 AUD (+GST only if applicable) paid in full is required to secure the booking, within five (5) days of receipt of invoice emailed to the parent/guardian, or as otherwise arranged directly with Autism & Beyond Australia. 

PROGRAM DETAILS, CANCELLATION AND REFUNDS:

Sessions days and times to be attended are as per the current programs listed on the website.

Each session is one hour and thirty minutes (1.5 hours) duration.

The Parent/Guardian is responsible for the Client/s outside of the session times.
The Coach is responsible for the Client/s inside of the session times.

The Parent/Guardian is required to hand the Client/s over to the Coach at the start of each session and is required to collect the Client/s at the end of each session.

 

The Coach is not required to physically take the Client/s to another location after the session has ended. Example: If the Parent/Guardian is waiting in their car during the session and doesn’t walk to where the session is taking place/finishing, the Coach is not required to walk the Client/s to the car, the Parent/Guardian is required to walk to the location of the session to collect the Client/s.

 

Sessions may be postponed by the Coach due to bad weather, sickness, injury or other extenuating circumstances experienced by the Coach. The Coach, or a representative of the Organisation will endeavor to contact the Parent to advise of this should the situation arise.

MISCELLANEOUS


Notice of missing sessions and/or late arrivals need to be provided in writing to the Coach via text message by no later than two (2) hours prior to the start of the session or as soon as possible. 

 

Refunds are not available after payment has been made.

 

Text and email reminders are not provided. Parents/Guardians are responsible for managing their own time and diary/calendar.

 

Session days and times are to be taken seriously by both the Parent and the Coach as professional appointments and as important commitments to adhere to.

It is the responsibility of the Parent/Guardian to ensure the Client/s arrives at each session on time and are collected on time at the end of each session.

 

It is the responsibility of the Parent to provide Carers, Support Workers and other 'official Guardians delivering and/or picking up Clients to and from program sessions with accurate start and end time, dates, location and Coach contact detail information relating the Program.

The Coach will always endeavor to arrive at sessions ahead of time and will contact the Parent/Guardian of any changes as soon as possible, via a phone call or text message.

There is no guarantee Clients will make friends during the course of the program.

​

Clients should bring their own suitable tackle to use each session but can use tackle supplied by the Coach if they don't have their own. The communal tackle needs to be looked after and returned to the Coach before the end of the session.

 

Bait is supplied by the Coach each session.

 

EQUIPMENT AND ASSOCIATED RISKS:

 

The Client is responsible for bringing, maintaining and managing own rod and reel each session. The Coach is not liable for any loss or damage to the Client's equipment at any time.

 

The Client is not to use the Coach's own equipment without direct permission provided by the Coach.

 

The Coach provides one (1) knife. Clients are not permitted to bring a knife to any session within the Service.

 

This Service includes the use and handling of sharp hooks that can cause harm and injury. The Coach teaches Service participants safe handling practices and is not liable for any injury or farm that may occur as a result of hooks being used within the Service.

 

The Client may handle fish with own hands which may include experiencing fish offal and other residue contact with clothing and equipment. The Coach is not responsible for any damage to clothing as a result of exposure to fish offal and other residue.

 

CATCHING & KEEPING FISH:

 

The Client is allowed to take home legal sized fish at the discretion of the Parent, and Parents are responsible for the transportation, cleaning and consumption of fish after each session has ended.

 

There is no guarantee the Client will catch fish during the course of the Service.

 

FEEDBACK:

 

The Parent is required to complete a feedback form within seven (7) days of the late session in the Service, sent via email.
